我們是為了信仰:為政教衝突致全國人大的公民請願書
全國人民代表大會常務委員會、吳邦國委員長:
       我們是中國的公民,愛自己的國家,關心社會和同胞的福祉,順服和尊重政府管理社會秩序的權力。我們也是普世基督教會的一群基督徒。因為看見近期發生在我國首都的政教關係危機,並且至今仍無化解的跡象,所以我們依法向執掌國家最高權力的你們發出請願書。
        北京基督教守望教會是近幾年迅速發展的城市新興教會中非常有代表性的教會,聚會地點處於北京中關村地區,信徒主要以知識份子為主,從幾年前的幾百人如今發展到一千多人。今年410日以來,守望教會因聚會地點的問題,連續幾周出現眾多信徒戶外敬拜,而幾百名信徒被警方拘留和訊問的事情。還有包括天明牧師等主要教會負責人在內的數百名信徒被非法限制自由,軟禁在家無法出門參加敬拜活動。其實,2009年,守望教會就曾因政府壓力被迫離開租用場所,戶外聚會。並在同年底,購買了位於中關村大恒科技大廈二層1500平米的寫字樓。但又在有關部門的壓力下,雖付了全款卻始終無法拿到鑰匙。20114月,守望教會再次被迫退出租用的場所,導致一千多名信徒無處可去,只好在戶外聚會、敬拜上帝,並造成了至今仍在延續的嚴重的政教關係危機。
        我們認為,守望教會事件不是某一間教會的個別和孤立的事件,而是社會轉型時期舊的宗教管理體制不適應教會發展而產生的政教衝突的典型現象。守望教會的遭遇深深牽動了中國數千萬基督徒在信仰裡互為手足的情感。2009年,在上海、廣州、成都、臨汾也發生過教會因聚會場所受到政府壓力而被迫舉行戶外敬拜的事件。隨著城市基督徒的不斷增長,教會的持續發展,這類政教衝突仍有可能繼續爆發。考慮到守望教會事件的典型性及這一事件對未來我國國家與教會關係的重大影響,我們特別發出此請願書。
        我們注意到:中華人民共和國《憲法》第36條、中國加入的《世界人權宣言》第18條,中國政府簽署的《公民權利和政治權利國際公約》第18條,都承認和規定了宗教信仰自由
我們認為,《世界人權宣言》第18條對宗教自由的定義,既是中國政府認可的,也是合乎我們信仰的:
        人人有思想、良心和宗教自由的權利;此項權利包括他的宗教或信仰的自由,以及單獨或集體、公開或秘密地以教義、實踐、禮拜和戒律表示他的宗教或信仰的自由。
因此,宗教自由包括了聚會、結社、言論、教育和宣教的自由。作為全世界歷史最久、規模最大、分佈最廣的宗教之一,基督教在絕大多數國家得享上述自由。
        但60年來,中華人民共和國《憲法》賦予我國基督徒的宗教信仰自由權利仍然未能得到落實。按照現行宗教管理政策,除非加入有著強烈政治色彩的三自愛國運動委員會,基督徒的各種宗教活動(包括聚會、敬拜、慶典、組建教會、修建教堂,以及宣教)仍然受到政府各種管理部門的限制和打壓。
        尊敬的吳邦國委員長、各位人大常委、人大代表,我們懷著為這個國家祝福的心,根據《憲法》第41條賦予公民的建議、批評、申訴和控告的權利向你們請願,請求你們和人大常務委員會根據《憲法》第71條的規定,啟動特別調查程式,成立宗教信仰自由特別調查委員會:
1、對北京守望教會無處穩定聚會的事件進行調查並督促北京市政府依法妥善解決;
2、審查現行《宗教事務條例》是否違憲;
3、提請制定《中華人民共和國宗教信仰自由保護法》。
        我們認為,宗教信仰自由是人類社會的第一自由,是國際社會的普遍價值,也是其他政治權利和財產權利的基石。沒有普遍公正的宗教信仰自由,一個多民族、多宗教的國家將無法形成和平的公民社會,無法帶來社會的穩定、民族的團結、國家的昌盛。
我們期待,借著特別調查委員會的啟動,政府能堅持以人為本、以法治國的原則,以服務公民的寬廣胸懷,理性而智慧地處理守望教會事件,避免更大規模的政教衝突,化危機為轉機,從而開啟政教關係良性互動的新階段。
        作為基督徒和熱愛自己國家的公民,我們願意持續地為我們的同胞和政府禱告,並為正在崛起、需要承擔更多普世責任的中國禱告,求上帝賜下平安、和好、穩定、發展的恩典,並讓公義、信德、仁愛、寬容、良善的文化充滿整個社會,使中國滿有上帝榮耀的同在!

We Stand Up for Our Faith -- A Petition to the National People's Congress Concerning the Conflict Between Church and State

The Standing Committee of the National People's Congress and Chairman Wu Bangguo,
We are Chinese citizens. We love our country, care about the society and the welfare of our countrymen, and obey and respect the authority of the government to maintain social order. We are also a group of Christians belonging to the universal Christian Church. We have observed the conflict between state and church unfolding recently in our capital Beijing and have so far seen no sign of the conflict being resolved, therefore, in accordance with law, we are lodging this Petition to you as the holder of the highest state authority.
Beijing Shouwang Church is very representative of the rapidly growing urban churches that have newly emerged in the last several years. Its place of congregation is located in the Zhongguancun area in Beijing. Its congregants are mainly intellectuals and well-educated professionals, and during the past several years, the number of its members has increased from several hundreds to more than one thousand. Since April 10, 2011, in light of the problems with Shouwang Churchs place of congregation, many of its members have held outdoor services for several consecutive weeks, and several hundred members have been detained and questioned by the police. In addition, the freedom of several hundred members (including the main leaders of Shouwang Church, such as its senior pastor Jin Tianming) has been illegally restricted, and they have been put under house arrest and prohibited from stepping out of their homes to participate in the worship services. In fact, Shouwang Church was forced in 2009 by governmental pressure to leave its rented place of worship and hold outdoor services. At the end of that same year, Shouwang bought 1,500 square meters of property at the second floor of Daheng Science & Technology Building in the Zhongguancun area in Beijing. But again, due to governmental pressure, Shouwang can not obtain the keys by any means even though it has fully paid for the property. Shouwang was forced once again in April 2011 to abandon its rented place of congregation. As a result, more than one thousand members have nowhere to go and have to hold outdoor services to worship God. All this has led to the serious crisis between state and church that is still unfolding as yet.
We believe that the Shouwang Church incident is not an individual, isolated episode that happens to a single church, but rather a typical phenomenon in respect of the conflict between state and church during the period of social transition. Such conflict has arisen due to the fact that the outdated system for religion management has not been adapted to the development of the church. The tribulations of Shouwang Church have profoundly stirred up the feelings among the tens of millions of Chinese Christians as brothers and sisters in their common faith. Similar incidents where a local church was forced to hold outdoor services due to governmental pressure on place of congregation took place in Shanghai, Guangzhou, Chengdu and Linfen as well in 2009. With the incessant growth of the number of urban Christians and the continued expansion of the church, the conflict between state and church of this sort is likely to continue to break out. In view of the representativeness of the Shouwang Church incident, and the significant impact of this incident on the future relationship between state and church in our country, we hereby lodge this Petition.
It comes to our attention that "liberty of religious faith" is accepted and provided for in Article 36 of the Constitution of the Peoples Republic of China, Article 18 of the Universal Declaration of Human Rights (to which China is a party), and Article 18 of the International Covenant on Civil and Political Rights, which was signed by the Chinese government.
We believe that the definition of "religious liberty" stipulated in Article 18 of the Universal Declaration of Human Rights is both accepted by the Chinese government and in compliance with our faith:
Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance.
Therefore, religious liberty is comprised of freedoms of assembly, association, speech, education and evangelism. As one of the longest, largest and most widely distributed faiths in the world, Christianity enjoys the above-mentioned freedoms in most countries.
Yet, for the last 6 decades, the rights to liberty of religious faith granted to our countrys Christians by the Constitution of the Peoples Republic of China have not been put into practice. According to the current policy for religion management, unless Christians join the strongly politically-charged National Committee of Three-Self Patriotic Movement, their various religious activities (including congregation, worship, ceremony, formation of church, construction of church buildings and evangelism) are still being restricted and suppressed by various governmental management departments.
The Honorable Chairman Wu Bangguo, each and every Honorable Member of the Standing Committee, and each and every Honorable Deputy to the National People's Congress, with the heart-felt wish to have this country blessed, and based upon the rights to suggestion-making, criticism, complaints and charges as granted to citizens by Article 41 of the Constitution, we lodge this Petition to you, and ask you and the Standing Committee to initiate the special investigation procedure and set up the special investigation commission for "liberty of religious faith" according to the provisions in Article 71 of the Constitution for the following purposes:
1. to conduct investigation into the incident where Shouwang Church can not have a fixed place to hold regular worship services, and to press the Beijing Municipal Government to come up with a sound solution in accordance with law;
2. to review the currently effective Rules for Religious Affairs to determine whether the Rules are constitutional or not; and
3. to propose to draft and adopt the Law of the Peoples Republic of China for the Protection of the Liberty of Religious Faith.
We believe that liberty of religious faith is the first and foremost freedom in human society, is a universal value in the international community, and is also the foundation for other political and property rights. Without the universal and equitable liberty of religious faith, a multi-ethnic, multi-religion country would not be able to form a peaceful civil society, or bring about social stability, ethnic solidarity or the nations prosperity.
We hope that by means of setting up the special investigation commission, the government will be able to handle the Shouwang Church incident in a rational and wise manner on basis of the principle of putting people first and ruling the country by law and in the gracious spirit of serving the citizens, so as to avoid the escalation in scale of the conflict between state and church, turn this crisis into an opportunity, and hence give rise to a new stage for the benign interaction in the relationship between state and church.
As both Christians and citizens who deeply love the country, we are willing to pray continually for our countrymen and the government, and pray for a rising China that needs to shoulder more universal responsibility. We plead for God to grant the graces of peace, harmony, stability and development, let the culture of righteousness, faith, love, tolerance and goodness permeate the entire society, and fill China with the Lord's glorious presence.
